Court of Appeal Case On Portland Cement Zambia Is Finally Over, Dr. Rajan Mahtani Wins Case

For the past ten years, Dr. Rajan Mahtani has been fighting the case of Portland Cement Zambia at numerous courts. The case was first registered at the Lusaka High Court, almost a decade back. Back then, Dr. Rajan Mahtani had to face numerous constraints and disadvantages such as corruption, unethical practices and irregular court sessions which ultimately resulted in a pendency of more than a decade. The judge at the Lusaka High Court was justice Nkonde who announced the final decision on the case. However, this decision was extremely controversial as the final decision said that Ventriglias were only shareholders of the Zambezi Portland Cement. As such, Dr. Rajan Mahtani was left with no option that to approach the Court of Appeal.

The Court of Appeal is one of the highest levels of judicial system in Zambia. The judge at the Court of Appeal was justice Mwinde who announced the final judgment on the case on 31st January 2019. This judgment was given after looking into all evidences and testimonials related to this case. It should be noted here that all these evidences were previously submitted by Dr. Rajan Mahtani’s lawyers at the Lusaka High Court but were never taken into consideration. As per the judgment from the Court of Appeal, Dr. Rajan Mahtani is the majority shareholder of the Zambezi Portland Cement with 58 percent shares at the factory. On the other hand, Ventriglias are the minority shareholders of the Zambezi Portland with only 42 percent shares at the factory. Based on this shareholding pattern, it is proven that Dr. Rajan Mahtani is the legal owner of the factory. Justice Mwinde also confirmed that this judgment aligned with the original shareholders agreement which was established in the year 2006.

As of now, all forgery related allegations established in the Court of Appeal have been refuted by the judge and a timeline of three months from the date of the judgment has been given for completing share regularization process.
