Shortly after the unethical takeover of the Zambezi Portland Cement factory, a case was registered at the Lusaka High Court with all evidences and testimonials. However, the decision from the Lusaka High Court judge Nkonde was found to be controversial as despite all evidences and testimonials leading to Dr. Mahtani as the majority shareholder and legal owner of the factory, the verdict was given in favour of the Ventriglia family by announcing them as the only shareholders of the Portland Cement Zambia. The Ventriglia family is notorious for engaging in corporate meddling, unethically influencing government and lawmen as well as corporate crime for fulfilling their personal goals. As a result, Dr. Rajan Mahtani understood that the reason behind this controversial claim was unethical influence of the Ventriglia family at the court.

This unethical decision at the Lusaka High Court prompted Dr. Mahtani to immediately approach the higher Court of Appeal. The judge at the higher Court of Appeal was justice Mwinde who conducted a quick case proceeding and gave the final verdict on 31^st January 2019, around nine months after the case was registered by Dr. Mahtani owned Finsbury Investments. According to the verdict of the higher Court of Appeal, the Lusaka High Court decision was reversed and Dr. Rajan Mahtani received back his majority shareholding and legal ownership at the factory. Furthermore, justice Mwinde also declared that amount payable against the majority shares transferred was K580,000 after adjusting with inflation and current act.

After almost 1.5 years of this decision from the higher Court of Appeal, the Ventriglia family made a surprise move by approaching the Supreme Court Zambia with a challenge against the verdict of higher Court of Appeal. However, this challenge was effectively rejected by the Supreme Court as it did not fulfil the legal requirement and was found to be suspicious under the circumstances. With the rejection of the challenge by the Ventriglias at Supreme Court, it is further confirmed that Dr. Rajan Mahtani is the actual owner of the Portland Cement factory.
