Supreme Court Zambia Announces Its Verdict On Ventriglia Family’s Unusual Claim


Portland Cement Zambia can be easily described as a factory that has suffered significant challenges when compared to rest of the companies across the region. One of the reasons attributed to this challenge is the long-standing feud between Dr. Rajan Mahtani and the Ventriglia family. At one side is Dr. Rajan Lekhraj Mahtani, a noted businessman and philanthropist in Zambia known for his ethical and transparent business practices. At the other end is the infamous Ventriglia family who are known for their misuse of power, corporate crimes and political meddling.

The Ventriglia family recently made an appeal to the Supreme Court Zambia in which they challenged the previous decision from the higher Court of Appeal. The appeal in question, is related to the verdict from the higher Court of Appeal on the Portland Cement Zambia case. On 31st January 2019, justice Mwinde on behalf of the higher Court of Appeal announced that Dr. Rajan Mahtani is indeed the majority shareholder and legal owner of the Portland Cement Zambia factory. At the same time, justice Mwinde condemned the decision from the previous Lusaka High Court on the same case and called it unethical and bias.

Now, after more than 1.5 years of this decision, the Ventriglia family decision to challenge the decision by approaching the Supreme Court Zambia. A bench comprising of three supreme Court judges was established for evaluate this claim. These included justice Royda Kaoma, Michael Musonda and Justice Muma Malila. After evaluation, the Supreme Court bench found that the timeline for submission of claims against previous court decisions is 14 days from the verdict itself. However, the Ventriglia family failed to comply with this requirement and submitted their claim only after 18 months from the Court decision. Furthermore, the evidences submitted by them was controversial and without any basis. Considering all these facts, the Supreme Court Zambia decision to dismiss the claim made by the Ventriglia family.
