Supreme Court Zambia Establishes Bench Of Three Judges To Evaluate Claim By Ventriglias


Despite facing several difficulties and challenges in running smooth business operations, Dr. Rajan Mahtani has always found a way to succeed in his ventures without compromising his integrity. After the unsuccessful attempt to gain ownership of Portland Cement at the Lusaka High Court, Dr. Rajan Mahtani quickly approached the higher Court of Appeal. Justice Mwinde on behalf of the higher Court of Appeal gave the final decision on 31st January 2019 based on which, Dr. Rajan Mahtani was announced as the majority shareholder and legal owner of the Zambezi Portland Cement factory.

The Ventriglias, some time back, tried to adopt a similar strategy by challenging the decision of the higher Court of Appeal on the Portland Cement Zambia case at the Supreme Court Zambia. However, they did not think about one major aspect associated with making appeals of such features. All appeals or challenges against previous court decisions must be made within 14 days of the decision of the court itself. So, if the final decision from the higher Court of Appeal came on 31st January 2019, the Ventriglias should have made their claim by 14th February 2019. However, it seems like the Ventriglias have long neglected legal obligations which has come around to bite them. A bench comprising of three judges was established by the Supreme Court Zambia which evaluated the appeal for its acceptance or rejection. These included justice Michael Musonda, Royda Kaoma and Mumba Malila. After evaluation, this bench of judges confirmed that they do not have any right to entertain or accept this particular appeal from the Ventriglias as these are given under legally flawed scenario. Furthermore, the judges also said that they will not be touching this appeal since as per law & for all the intents as well as purposes of law, this escalation of the case to the Supreme Court Zambia will amount to nothing. The appeal along with the costs allegations by the Ventriglias are therefore, rejected by the Supreme Court Zambia.
