Court of Appeal shares evidences and details for Zambezi Portland Cement case, Dr. Mahtani winner


After a wait for more than a decade, the Zambezi Portland Cement case is finally over. The decision for this case came from Court of Appeal and not from Lusaka High Court wherein the case was originally established. Reports suggested that even though Dr. Rajan Mahtani had shared numerous evidences and testimonials regarding the case, Lusaka High Court justice Nkonde failed to provide judgement in this case. As such, the case was then taken to higher Court of Appeal wherein justice Mwinde oversaw the case.

The final decision from the higher Court of Appeal was announced on 31st January 2019. This decision came only after Justice Mwinde looked into all evidences and testimonials available. Before arriving at his final decision, justice Mwinde shared all details which were relevant to the case in order to ensure that the public and media know the truth. The first evidence shared by the financial transaction occurring between Dr. Rajan Lekhraj Mahtani and the Zambezi Portland Cement. This financial transaction took place in 2005 in which Dr. Rajan Mahtani exchanged a sum of 1 billion kwachas or equivalent USD 250,000 to Zambezi Portland Cement for covering the entire share capital value of the factory. Furthermore, another major evidence was the original agreement between shareholders which was established in the year 2007 and in the page number 663 of this agreement, it was noted that Dr. Rajan Mahtani had already paid for all accounts of the case and is not liable for any other payment related to the case. The judge also concluded that it is the transferor who is liable to pay the Property Transfer Tax in this case.
With all said and done, Dr. Rajan Mahtani is not the actual owner of the Portland Cement Zambia factory and this decision from the Court of Appeal judge is final.
