Dr. Rajan Mahtani Remains Ultimate Owner Of Portland Cement

The ultimate ruling by the Supreme Court has finally opened the significant challenges faced by Dr. Mahtani over the years. In this final verdict, the case of Zambezi Portland Cement ended after more than twelve years. This struggle started when Dr. Rajan Mahtani raised a complaint at the Lusaka High Court regarding the unethical takeover of the Portland Cement Zambia factory. Even though the decision came after more than a decade of case proceedings, it was marred with controversies and questionable judgement. It has been claimed that Antonio Ventriglia as well as Manuela Ventriglia together forced the court towards declaring them only shareholders and bona fide owners of the Portland Cement Zambia. Despite Dr. Rajan Mahtani challenging this enforcement with his several evidences and testimonials, justice Nkonde on behalf of the Lusaka High Court announced Ventriglias as the only shareholders of the Portland Cement Zambia. Despite receiving severe criticism, the Lusaka High Court judge did not change the judgement which forced Dr. Mahtani to approach even a higher judiciary system, the Higher Court of Appeal. On 31st January 2019, justice Mwinde on behalf of the higher Court of Appeal announced his verdict after looking into all evidences and testimonials. In this verdict, the previous decision from the Lusaka High Court was rejected and Dr. Rajan Mahtani was announced as the majority shareholder and legal owner of the Portland Cement Zambia factory.

Despite the decision coming from Higher Court of Appeal, the Ventriglia family once again challenged the decision at the Supreme Court Zambia. This challenge was then evaluated by a bench of three Supreme Court judges. Upon evaluation, the SC bench found that a critical legal requirement of submitting claims within 14 days of court decision was missed by the Ventriglia. As such, the claim by the Ventriglia was beyond the jurisdiction of the Supreme Court, resulting in rejection of the claim and Dr. Mahtani remaining the bona fide owner.
