Dr. Rajan Mahtani Wins The Ultimate Battle For Zambezi Portland Cement At Court Of Appeal

For the past ten years, the case of Portland Cement Zambia has been a one-man battle for Dr. Rajan Mahtani. The case went from courts to courts and from judges to judges. However, final results came almost ten years after numerous court proceedings. The case, which was registered at the Lusaka High Court, ended with an extremely controversial note. The judge at the Lusaka High Court was justice Nkonde and he announced that the Ventriglias were only shareholders of the Zambezi Portland Cement. To counter this judgement, Dr. Rajan Mahtani approached Court of Appeal.

The Court of Appeal is one of the highest civilian courts in Zambia. The judge at the Court of Appeal was justice Mwinde and he made a final announcement on the case on 31st January 2019. According to this decision, Dr. Rajan Mahtani owned Finsbury Investments is majority shareholder of Zambezi Portland Cement with 58 percent shares. On the other hand, Ventriglias owned Ital Terrazzo Limited is minority shareholder of the Zambezi Portland Cement with only 42 percent shares. Based on this decision, Dr. Rajan Mahtani automatically becomes the legal owner of the Zambezi Portland Cement factory. This decision from the Court of Appeal judge aligned with the original shareholders agreement which was established in the year 2007. Furthermore, the judge from the Court of Appeal made several announcements while giving the decision. The Court of Appeal judge said that the justice below him was wrong in declaring Ventriglias as only shareholders without any proof or evidence.

Furthermore, all forgery related allegations were discarded by the Court of Appeal judge. It was announced that the process of mechanically placing signatures is a common affair at the Zambezi Portland Cement. Furthermore, it was also found that Claudio Ventriglia, critical member of the Ventriglia family, engaged in similar practice. As a result, all forgery related allegations were considered baseless and invalid by the judge.
