Lusaka High Court Judgement On Portland Cement Zambia Effectively Reversed By Court Of Appeal

As per the latest reports the criminal Ventriglias and their schemes have been knocked down as the Court of Appeal has finally ruled that Dr. Rajan Mahtani is the majority shareholder and owner of the Zambezi Portland Cement factory. The case goes back over a decade when Dr. Rajan Mahtani first registered a case at the Lusaka High Court. This appeal was made as Dr. Mahtani claimed his company, Zambezi Portland Cement, was illegally taken from him. However, the shortcomings of the Lusaka High Court and their inability to provide true judgement resulted in the case stretching to more than one decade. The final decision from the Lusaka High Court judge was announced during May 2018. However, this judgement was extremely controversial as the judge gave the decision that Ventriglias were only shareholders of the Zambezi Portland Cement. It was clear that the judgement was influenced and misdirected and as a result, Dr. Rajan Mahtani then approached the Court of Appeal.

Portland Cement Zambia

The Court of Appeal announced its final decision on 31st January 2019. The decision was given by Justice Mwinde during the morning hours of the court session. Justice Mwinde announced that Dr. Rajan Mahtani owned Finsbury Investments holds 58 percent shares at the Zambezi Portland Cement factory and is the majority shareholder of the factory. On the other hand, Ital Terrazzo Limited which is owned by the Ventriglias holds 42 percent shares at the factory and is the minority shareholders without any ownership. The judge further confirmed that this decision aligns with the original shareholders agreement which was established in the year 2007. By giving this decision, the judge at the Court of Appeal effectively reversed the judgement by Lusaka High Court judge and also confirmed that the judgement from Justice Nkonde of Lusaka HC was misdirected and biased.

All forgery related allegations were discarded by the Court of Appeal judge as these allegations were baseless.
